International law firm Clyde & Co has acted for Oxford Aviation Services Limited and their aviation insurers in relation to claims arising out of the crash of a Piper PA-34 Seneca III aircraft.
The well-publicised crash, which occurred at Newmarket Racecourse on June 1 2000, involved jockeys Frankie Dettori and Ray Cochrane. Tragically, pilot Patrick Mackey died in the accident, which also involved the total loss of the aircraft.
Judgement in the case was handed down by the Honourable Justice Cooke on Friday, February 13.
Clyde & Co’s claimant clients
were successful in recovering the value of the aircraft, outstanding
hire amounts and loss of profits,
and also obtained indemnities in respect of passenger claims. The claimants were also awarded
interest and costs.
Commenting on the case, aviation partner Colin Franke said: “Whilst
we are very pleased to have won
the case, which involved a number
of different elements, it is perhaps
a shame, particularly given the
tragic circumstances of the case, that the matter could not have been resolved short of trial.”
